1. Introduction

Welcome to Elegante Dove Design! These Terms and Conditions (“Terms”) govern your use of our services and products, including our website, design services, and any other related services (collectively referred to as “Services”). By using our Services, you agree to these Terms in full. If you disagree with these Terms or any part of these Terms, you must not use our Services.

2. Services

2.1 Design Services

We offer a range of graphic design services including, but not limited to, logo design, branding, web design, print design, and custom illustrations. Each project will be outlined in a specific agreement detailing the scope, timeline, and deliverables.

2.2 Design Products

Our design products include pre-made templates, digital artwork, and other design-related products available for purchase through our website.

3. Orders and Payments

3.1 Placing an Order

To place an order for our Services or products, you must provide complete and accurate information. Once an order is placed, you will receive a confirmation email.

3.2 Payment Terms

All payments must be made in full at the time of order unless otherwise agreed. We accept various forms of payment including credit cards and electronic transfers. Late payments may result in the suspension of Services.

3.3 Pricing

All prices are subject to change without notice. We will honor the pricing at the time of your order placement.

4. Delivery and Acceptance

4.1 Delivery

We will deliver the completed design Services or products by the agreed-upon deadline. If there are delays, we will communicate promptly.

4.2 Acceptance

You are responsible for reviewing all deliverables. Any revisions must be requested within 7 days of delivery. If no feedback is provided within this period, the deliverables are deemed accepted.

5. Intellectual Property

5.1 Ownership

Upon full payment, you will receive ownership rights to the final design products. However, we retain the right to use the work for promotional purposes unless otherwise agreed.

5.2 Right of ownership for Print on demand

When you contact us to design a product/graphics that suit your taste, you do not own or retain the right of ownership for the product or service. Elegante Dove owns the right to use, modify, and resale the product. However, due to ethical consideration, we modify the design not to include any personal information that can be directly linked to you. If you would like to own the design after buying the custom product, then you will have to contact us to discuss the full price of the Design. 

5.3 Licensing

For pre-made design products, you are granted a non-exclusive, non-transferable license to use the product for personal or business use. Redistribution or resale of our products is prohibited. 

‍5.4 License limitation

When you purchase  our pre-made asset or standalone asset, you may NOT Produce merchandise, templates, or other items for sale or distribution where the main value of the product is tied to the asset itself. For instance, you cannot use the asset to create a poster, t-shirt, or coffee mug that people would purchase primarily because of the asset displayed on it.

6. Revisions and Modifications

6.1 Revisions

Revisions are part of our design process. The number of included revisions will be specified in the project agreement. Additional revisions may incur extra charges.

6.2 Modifications

Any changes to the project scope or deliverables must be agreed upon in writing and may result in additional costs.

7. Cancellations and Refunds

7.1 Cancellations

If you wish to cancel your order, you must notify us immediately. Cancellation fees may apply depending on the project stage.

7.2 Refunds

Refunds are not provided for completed Services or delivered products. For partially completed Services, refunds may be issued at our discretion, minus any costs incurred.

8. Limitation of Liability

We are not liable for any indirect, incidental, or consequential damages arising from the use of our Services or products. Our total liability is limited to the amount paid by you for the Services or products in question.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of our Services or products, or your breach of these Terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of Sweden. Any disputes will be resolved in the courts of Sweden.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be posted on our website and will become effective upon posting.

 

12. Purchasing

The term “purchase” as used in our privacy policy or terms and condition applies to both FREE and Priceable product. Thus, downloading and paying a fee or not is part of the term “purchase” as described in our policies.
